These Terms & Conditions ("Terms") govern your use of Mya, the WhatsApp assistant operated by Earngage, and our website at getearngage.com (the "Service"). By messaging Mya or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who may use the Service

You may use the Service only if you are at least 18 years old and legally able to form a binding contract. By using the Service, you confirm that you meet these requirements.

2. What the Service does

Mya onboards creators and brands on WhatsApp, learns about the campaign goal and budget, and selects creators who fit the brief. Earngage facilitates introductions and matches but is not a party to any agreement reached between a creator and a brand.

3. Your account and information

You agree to provide accurate and current information when onboarding with Mya, including your identity, social media handles, niche, and campaign details. You are responsible for keeping your WhatsApp account secure and for all activity that occurs through it.

4. TikTok data

When you connect your TikTok account, you authorise us to read your public profile and video statistics through TikTok's API. We collect your TikTok account ID, username, display name and profile picture, your follower count and total video count, and for your recent videos the view, like, comment and share counts, post dates and links. We use this to build the performance profile brands see when deciding whether to hire you, and to show you your own reach and engagement. We do not post to your TikTok account and we do not access private data. You can disconnect TikTok at any time by messaging Mya on WhatsApp, which deletes the access we hold, and you can revoke access from your TikTok account settings.

5. Creator and brand conduct

You agree not to use the Service to misrepresent your audience, follower counts, or engagement, or to engage in fraud, impersonation, harassment, or any unlawful activity. Brands agree to provide honest campaign briefs and to honour agreed terms with matched creators.

6. Consent and sharing

A creator's information is shared with a brand only after the creator gives explicit consent through Mya. Earngage is not liable for outcomes arising from information a creator chooses to share after giving consent.

7. Intellectual property

All content, branding, and materials provided by Earngage — including the Mya name, likeness, and voice — remain the property of Earngage. You may not copy, modify, or distribute our intellectual property without written permission. Content you create as a creator remains yours.

8. Limitation of liability

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Earngage is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, or from any match, collaboration, or communication facilitated through Mya.

9. No guarantee of matches

We do not guarantee that Mya will find a suitable match for every creator or brand, nor do we guarantee any specific outcome from a collaboration. Match suggestions are based on the information you provide and may not always result in a partnership.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access to the Service if you breach these Terms or if we believe your activity poses a risk to the Service or other users.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or the Service shall be resolved in the competent courts of Nigeria.
